Terms & Conditions:-
Accuracy
The information give is as accurate as we can make it. The description is of amenities normally available. However, circumstances can change due to any event beyond or control. Major road works may necessitate route changes. Indian restaurants may close or change management. All of these may cause us to changes in the itineraries. Where we may know of these sufficiently in advance we will notify you, otherwise our Tour Managers or Local Representative will inform you of the changes on the spot. Please note that the itineraries were produced a few months in advance. There are also very big Conventions and Exhibitions lasting upto 2 weeks, where all the hotels are fully booked several years ahead. Every effort is made to avoid such dates, but in the few instances where it is unavoidable, it may be necessary to stay in hotels in other cities. (This would be advised at the time of booking).
Meals
We reserve the right to change the meal arrangement if circumstances make it necessary to do so: the meals are pre-set and a choice of menu is not available.
Hotels
On your tour will be provided rooms with private bath or shower in your hotel. The hotel will either be those mentioned in the itinerary or of a similar category. Some of our hotels are centrally located in the cities, but in common with other Tour Operators, we have found that to provide you with comfortable hotels at reasonable prices, it is often necessary to use hotels away from city centers.
Currency & Travelers Cheques
We suggest you to take your holiday spending money partly in currency, partly in traveler’s cheques. Travelers cheques are by far and safest way to carry money as they are easily encased for a small service fee and can be replaced, if they are stolen or lost, provided you have the lost travelers cheques numbers and the counterfoil.
Safe Deposit Lockers
Safe Deposit Lockers are available in most hotels. You are advised to keep your valuables in the safe deposit lockers, at the time of check in and not in your hotel rooms.
Coach/Sitting
We use air-conditioned / air –cool luxury coaches. We have found it fair to operate daily seat rotation on board our coach, so no seat numbers are allocated. If you are carrying any high value items on the coach we advice you not to leave them behind when you leave the coach.
Baggage Allowances
One suitcase per person (Convenient Size 30”x 18”x 10”) plus a small holdall to keep on the coach – this will make things so much simpler at the various overnight stops.
Holiday Allowances
For your peace of mind you should ensure you and your party are adequately covered by a comprehensive Travel Insurance Policy. Your travel agent will recommend the most suitable to your needs. Be sure to take all the relevant documentation with you when you travel.
Tipping
Tipping is mandatory in all parts of world for services rendered (e.g. porters, coach drivers etc.). Your Tour Manager will be pleased to advise you of the same.
Scope of Activity
We are travel and holiday organizers only, We do not control or operate any airlines, neither do we own or control any shipping company, coach or coach company, hotel, transport or any other facility or service mentioned. We take care in selecting all the ingredients in your holiday; but because we only select and inspect them and have no control in running of them, we cannot be responsible for any delay, improper services provided by any agency, airlines, transport, hotel, any provider of services, for any injury death, loss or damage which is caused by the act or default of the management or employees of any hotelier, airlines, shipping company coach owner / coach operator who are the Company’s independent Contractor arising outside our normal selection and inspection process.
We are also not responsible for the delay or deficiency in services provided by agency, airlines, transport, hotel, any provider of services, or/and any act or actions of co-travelers, co-passengers which may result in availing the following and/or other services on the tour.
Definition
a) Clients mean the person/persons in whose name and/or whose name is on the Booking form.
b) Company means Gem Tours & Travels Pvt. Ltd.
c) Independent Contractors means “any hotelier/hotel owner, owner of any Airlines or Shipping company or Railway, Ferry Boat Owner/Operator, Cruise, Coach Owner/Operator or any other Person or Organization who have been selected by the Company to render services to the client”.
1. There is no contract between the Company and the client until the Company has received the appropriate nonrefundable deposit. The full payment must be received in accordance with procedure laid down under the heading “PAYMENT PROCEDURE”. If not paid in that time the Company reserves the right to cancel the booking with consequent loss of deposit and apply scale of cancellation charges as mentioned.
2. The Company has the right at any time and for any reason:
a) To terminate Contact after acceptance of deposit but prior to the Commencement of Tour without assigning any reason whatsoever. In the event, the Company terminates the Control; the Company may refund the amount deposit to the Client without payment of any interest.
b) To amend, after, vary or withdraw any tour, holiday, excursion or facility it has advertised or published or to substitute an independent Contractor of similar class if it is deemed advisable or necessary. In either case, the Company shall not be liable for any damage, additional expense or consequential loss suffered by the clients or for any compensation claim.
2A. It is the responsibility of the client to hold valid transfer documents such as passport and visas and to furnish all documents required by the Company for application of the same. In the event the application for visa made by any client or by the Company on behalf of the client is rejected by the concern embassy or authorities due to inadequate documents furnished by applicant or due to any other reason whatsoever, the company shall not be liable or responsible for the same. All cost, charges in respect of the said application for the visa shall be borne by the client.
3. No person other than the Company, in writing, has the authority to vary, add, amplify or waive any stipulation, representation, term or condition set forth.
4. The event of the Company exercising its rights to amend or alter any tour or holiday advertised after such tour or holiday has been booked, the client shall have the right:-
a) To continue with the tour or holiday as amended or altered.
b) To accept any alternative tour or holiday which the company may offer. In either of these above cases the Client should not be entitled to or the Company shall not be liable to the client for any damage, additional expenses, consequential loss suffered by him or to pay any amount as refund.
c) In the event that the company is unable to conduct a particular tour, the company shall at its own discretion refund the amount of the cost of the said tour to the client without any interest on the same. The client will not be entitled to make any grievances thereafter in respect of the same.
5. The Company shall, in no circumstances whatsoever be liable to client or any person traveling with him for:-
a) Any death, personal injury, sickness, accident, loss, delay, discomfort, increased expenses, consequential loss and/or damage or any kind of theft howsoever caused;
b) Any act, omission, default of any independent Contractor or other person or buy any servant or agent employed by them who may be engaged or concerned in the provision of accommodation, refreshment, carriage facility or service for the Client or for any person traveling with him howsoever caused.
c) The temporary or permanent loss of or damage to baggage or personal effects howsoever caused. In this condition the expression “howsoever caused” includes willful negligence on the part of any person.
d) If in the event that the client is booked on a particular airline and due to certain reasons the said flight is over booked and the client is not allowed to board the flight, the client shall not hold the company responsible for the same and no claim whatsoever can be made by the Client against the Company.
6. No liability on the part of the Company arising in any way out of this Contract in respect of any tour, holiday, excursion facility shall exceed the total amount paid or agreed to be paid for the tour holiday and shall in no case include any consequential loss or additional expense whatsoever.
7. a) If the client has any complaint in respect of services provided by any of the independent Contractors, the client shall immediately notify the same in writing to the independent Contractor and a copy thereof should be handed over to the Tour Manager of the Company in order to enable the Company to take up the matter with the Independent Contractor. b) Any claim or complaint by the Client must be notified to the company in writing within Twenty Days of the end of Tour. No claim notified to the Company outside this period will be entertained and the Company shall incur no liability whatsoever in respect thereof.
8. If is hereby declared that the immunities provided under this contract shall be available to the Company’s Manager, including Tour Managers, Employees, Servants and Agents but not to the Independent Contractors selected by the Company.
9. Each of these conditions shall be severable from the other and if any provision be invalid, illegal or unenforceable the remaining provisions shall nevertheless have full force and effect.
10. It is a condition of Booking that you take out a Holiday Insurance from your Local Travel Insurers and purchase your Foreign Exchange through your booking agent from the Company/agency nominated by the company.
11. The prices quoted for the tours have been calculated at the rate prevailing at the time of printing of this Brochure. The Company reserve the right to amend the prices published in this brochure in case of currency fluctuations, changes in the various cross rate of exchanges, and/or fuel costs, before the date of departure and to surcharge accordingly. All such increases in price must be paid for in full before departure by the client.
12. For all claims, disputes of whatsoever nature relating to the Tours marketed/coordinated by Gem Tours & Travels Pvt. Ltd. The courts in Mumbai Shall alone have jurisdiction.
13. If no suit/action is brought against the Company within three months of the Tour, the Company shall be discharged from all liabilities under/or arising out of this Contract and the Client shall be Deemed to have forfeited/abandoned all his rights under or arising from this Contract.
14. All tours are subject to laws, rule of RBO/GOI.
Booking And Payment
You must complete and sign the official Gem Booking form which gives the Booking Conditions of the Tour. Please complete one booking Form per party. (You can contact us for the same)
Along with the Booking forms please enclose a non refundable and interest free deposit amount of Rs. 25,000/- per person (Adult/Child)
This said deposit mentioned will be adjusted towards the cost of the Tour.
Travel Documents
It is your responsibility to hold valid travel documents such as Passports, Visas, confirmed Air Tickets to be able to travel on this Tour. The cost and processing Visas and Passports is not included in the Tour. The cost and procedures Visas and Passports is not included in the Tour price and you are required to pay for them separately.
It would be best to check with the Gem Branch Officer or District Sales Office nearest to you or your own trusted Travel Agent for advice and information. Please ensure with them that your travel documents can be processed in time for your departure, as it is their specific responsibility to do so.
Balance Payments
Balance payments towards the cost of your Tour (INR amount) must reach us at least 35 days prior to the departure of your tour.
Your final documents and airlines tickets can only be issued, provided your balance INR payments has reached us 35 days prior to the departure of your tour. There will be delay in issuing your Air Tickets unless the Full INR Payments are made in the stipulated time.
Please ensure that full and final payments towards the US Dollar component of your tour. If it does not, this would result in the cancellation of your seat on the tour. We will then be constrained to levy.
Cancellation Charges
You will receive your Air Ticket from us 7 days prior to the departure, along with your Gem Confirmed Passenger Tour Ticket (PTT), provided we have received full payment including foreign currency component in the form of Travelers cheques and cash as may be permissible.
Your Confirmed Passenger Tour Ticket (PTT) entitles you to travels on the Tour, and must be presented by you to the GEM Tour Manager on the first day of the Tour.
Airline ‘change in the reservation fee’
It is absolutely necessary to have your return air seats to India confirmed, prior to your departure from India.
Passengers wishing to change their return reservations to India after departure will have to pay ‘Change in Reservation Fee’ directly to the airline, subject to the availability of the seats in the same booking class. This fee could range from US$75 per person depending upon the airline.
Amendments
A transfer from one tour another 45 days prior to the departure will be treated as cancellation from one tour and a fresh booking on another. In these cases Transfer fee of Rs. 5000 per person will be applicable.
Cancellations
If circumstances make you cancel your tour, the cancellation must be intimated to us in writing and cannot be accepted by telephone. As per the Booking conditions of the tour we are constrained to levy the following Cancellation Charges.

35 days or made prior to the departure of the tour or for Deposit Amount nonpayment of the balance amount.
34 – 25 days prior to the departure of the tour. 25% of the tour cost
24 – 15 days prior to the departure of the tour. 50% of the tour cost
14 – 10 days prior to the departure of the tour. 75% of the tour cost
In case you are a ‘No Show’ on the tour. 100% of the tour cost
Note:
Please note that all the mentioned tour cost is based on 30 pax traveling in a group.
Accident
Company is not responsible in the case of any accident occurred during the tour.
Gem Tours & Travels reserves the right to cancel any Tour prior to the departure, without any reason.
All Moneys paid by you will be fully refunded forthwith in Indian rupees currency only but no compensations are payable.
Refunds
Refund (if any) for amendments and/or cancellations will be paid directly to you by Gem Tours & Travels Head Office, it would take at least 30 days to process refunds.
In Case of refund of Foreign Currency component, the said refund shall be made in Indian Rupees at precalling rate on date of refund as per exiting Rules Regulations.
There is NO REFUND payable for any Unutilized Services (e.g. Meals, Entrance Fees, Optional Tours, Hotels, etc.)
